Music Industry, YouTube in Stalemate Over Copyright Tracking

The music industry and YouTube disagree over the efficacy of YouTube’s Content ID system, which tracks content for which royalties are due. According to YouTube, Content ID is 99.7 percent accurate and responsible for $3 billion in payments to the music industry. However, music rights holders put Content ID’s accuracy at about 50 percent, adding that they must engage in time-consuming daily manual searches to find offenders. Artists, RIAA Target YouTube in Latest Round of Royalty War

In the latest battle between musicians and streaming outlets, the music industry has united to fight YouTube for higher royalties. Katy Perry, Pharrell Williams and Billy Joel signed letters requesting changes to copyright laws; high-profile manager Irving Azoff criticized YouTube in an interview and a Grammy Awards speech. Recently released annual sales statistics buttress the musicians’ point of view: statistics show that, despite huge audiences, YouTube pays less direct income to musicians than vinyl record sales. SoundCloud Debuts Subscription Plan in U.S. with 125M Songs

Berlin-based SoundCloud, which began signing licensing deals with major and indie record labels in 2014, just debuted its new subscription plan. The online music service’s 175 million regular users will now have the option of the free version, which features 100 million songs, or the $10/month subscription version, SoundCloud Go, which offers 125 million ad-free songs, and lets users save songs to their phones. Streaming Boosts Music Revenues, But Not Equally for Artists

The Recording Industry Association of America reports that streaming is booming, more than offsetting declines in CD sales and digital downloads. In 2015, overall revenues rose almost 1 percent to $7 billion, the fifth consecutive year that the market grew — albeit slightly — in wholesale value. But artists and their representatives are saying that the gains aren’t being fairly shared, since many users still listen for free. Spotify, Music Publishers Settle Mechanical Licensing Dispute

Spotify and the National Music Publishers’ Association settled a long-standing licensing dispute, although neither will reveal details. Sources say Spotify will pay between $16 million to $25 million in royalties that are owed but unpaid, as well as a $5 million penalty. In exchange, the publishers will not file copyright infringement claims. The suit hinges on a rule governing mechanical licensing rights that dates back to player-piano rolls. Warner, Sony Commit to Divvy Spotify Sales Gains with Artists

Warner Music Group, which has ownership stakes in streaming services, will now share revenue with artists if and when those services go public or are sold. Following Warner’s lead, Sony Music confirmed it would do the same. Analysts believe the move is an attempt to woo artists who receive miniscule returns from streaming. Two other trends leave musicians out in the cold: royalties are often not pegged to a specific song and record labels have traded more generous royalty rates for part ownership of streaming services. SoundCloud Strikes New Licensing Deal with Universal Music

Streaming music site SoundCloud will now have access to the Universal Music catalog, including songs from artists like The Weeknd, Sam Smith and U2. The licensing agreement allows Universal Music artists to make money from the advertising on SoundCloud when their songs are played. SoundCloud already has licensing agreements with other music companies, including Merlin and Warner Music Group. Boon for 4K: HEVC Advance Lowers Video Licensing Rates

The prospects of 4K video have brightened. That’s because the HEVC Advance group that licenses the H.265/HEVC video format enabling 4K’s higher data rate to traverse through existing pipes just adjusted its royalty rates. Up until now, the group wanted steep rates, even from free outlets, and without a cap. With the new, revamped licensing scheme, HEVC Advance not only cuts rates in half but sets a yearly cap between $2.5 million to $40 million per year, depending on the service or device type. Federal Ruling Updates Royalty Rates for Streaming Music

When a panel of federal judges increased the royalty rates that free Internet radio services pay, there were winners and losers. The rate for pure-play Internet services rose to 17 cents from 14 cents, disappointing SoundExchange, the non-profit licensing agency representing record companies, which had asked for 25 cents. The Copyright Royalty Board also evened the playing field between pure-play and broadcasters with Web streams such as iHeartRadio, with the latter owing less — 22 cents rather than 25 cents — for their paid subscriptions. Pandora Buys Ticketfly, Boosting Ticket Sales for Live Events

Pandora just bought ticketing company Ticketfly, a move that furthers the company’s goal to improve relationships with the musicians whose music it plays. Ticketfly will enable artists to promote live events and sell tickets to local listeners. Pandora’s move will likely nudge other streaming music services to follow suit. The Ticketfly purchase comes on the heels of Pandora’s development of its Artist Marketing Platform, AMP, a portal for artists. MPEG LA Calls for Patents to Organize Joint DASH License

MPEG LA announced a call for patents for MPEG-DASH (Dynamic Adaptive Streaming over HTTP), to the dismay of many industry watchers. When MPEG-DASH first debuted in 2011, the issue of royalties wasn’t raised and DASH was quickly and widely deployed, in everything from browsers to smart TVs. The problem is that DASH is an integral part of HTML5, which is beginning to displace Flash.
