FTC Seeks to Bolster COPPA So Firms Can’t Surveil Children

The Federal Trade Commission has proposed new rules to strengthen the Children’s Online Privacy Protection Act (COPPA), further limiting the collection of children’s data, particularly those who seek to monetize the information through targeted advertising. FTC Chair Lina Khan says the proposed changes aim to prevent tech firms “from outsourcing their responsibilities to parents” when it comes to ensuring privacy for children’s data. The FTC says it has issued fines totaling hundreds of millions of dollars to Google’s YouTube, and to a lesser extent, ByteDance’s TikTok, for mishandling the data of children 13-years-old and younger. Dozens of States Sue Meta for Social Media Addiction in Kids

Meta Platforms has been sued in federal court by 33 states including California and New York that claim its Instagram and Facebook platforms addict and harm children. The action is to date the most sweeping state action to contend with the impact of social media on the mental health of children. The suit, filed Tuesday in U.S. District Court for the Northern District of California, alleges Meta violates consumer protection laws by targeting children and deceiving users about platform safety. Government Advances Online Safety Legislation for Children

The Senate has cleared two children’s online safety bills despite pushback from civil liberties groups that say the digital surveillance used to monitor behavior will result in an Internet less safe for kids. The Kids Online Safety Act (KOSA) and the Children and Teens’ Online Privacy Protection Act (COPPA 2.0) are intended to address a mental health crisis experts blame in large part on social media, but critics say the bills could cause more harm than good by forcing social media firms to collect more user data as part of enforcement. The bills — which cleared the Senate Commerce Committee by unanimous vote — are also said to reduce access to encrypted services. Bipartisan Congressional Effort Afoot for Tougher Tech Laws

Riding the momentum of Washington hearings and media criticism, legislators are pushing forward various bills to regulate Big Tech. Amy Klobuchar (D-Minnesota) and Chuck Grassley (R-Iowa) led fellow Senators in pushing legislation that would prevent tech platforms from favoring their own products and services, lending weight to efforts already progressing in the House. House Energy and Commerce Committee leaders have put forward their own proposal to prevent social-media companies from boosting circulation of harmful content. At the forefront are initiatives to limit the collection of personal info from minors, as well as restrictions on marketing to children. FTC Is Considering the Need for Stricter Online Privacy Rules

The Federal Trade Commission is looking into establishing stronger online privacy protections that would hold businesses such as Facebook, Google and Twitter more responsible for how they handle consumer data. The early discussions, under the leadership of new chair and vocal Big Tech critic Lina Khan, are addressing the possibility of introducing FTC regulation due to what is perceived as gridlock in Congress in creating a federal law. Privacy and civil rights groups have advocated for a single federal law — similar to Europe’s General Data Protection Regulation (GDPR) — rather than state laws (or no regulation at all). Pixalate Raises $18.1M to Combat Click Tricks and Ad Fraud

Analytics firm Pixalate has announced $18.1 million in growth capital for connected TV and mobile advertising initiatives. The new round brings total capital raised to $22.7 million for the 9-year-old firm, which specializes in fraud prevention, privacy protection and legal compliance via offices in Santa Monica, Palo Alto and London. The move comes as Pixalate rises to meet the challenges of enterprise clients fending off bot attacks, ad fraud and other malicious threats. Malware incursions by intruders like Puppeteer siphon tens of millions of dollars in annual ad revenue, according to Pixalate. TikTok Used Privacy Loophole to Track Android Users’ Data

Google limits how Android apps track users, and it appears that TikTok violated this policy by collecting unique identifiers — called MAC addresses — from millions of mobile devices. In fact, TikTok seemed to have concealed this action via an added layer of encryption. TikTok, which has publicly declared it doesn’t share data with the Chinese government, ended the collection of MAC addresses in November. Bipartisan Bill Would Further Regulate Online Content for Kids

Senators Ed Markey (D-Massachusetts) and Richard Blumenthal (D-Connecticut) introduced the Kids Internet Design and Safety (KIDS) Act, which would regulate how companies such as YouTube and TikTok handle what is accessible to children online, including advertising, app design and potentially harmful content. One of the main targets of the new bill are so-called unboxing videos, such as YouTube channel “Ryan’s World,” which can get millions of views. The KIDS Act would not ban the content, but prohibit the platform from recommending it to kids, curbing its distribution. CTA director of regulatory affairs Rachel Nemeth, who moderated a CES panel on innovation and privacy, asked Baker Botts co-chair, antitrust group Maureen Ohlhausen to put the topic in historic context. “The Congressional debate on the Fair Credit Reporting Act (1970) brought forward many of the same issues we’re discussing today,” said Ohlhausen, who also served as a commissioner and acting chair of the FTC. “People were worried about computers and the use of their data. YouTube Limits Data Collection, Targeted Ads on Kids’ Videos

This month, Alphabet-owned YouTube will begin limiting the data it collects on children’s videos and stop showing data-driven personalized ads. Video creators will be responsible for designating their content as targeting children and will face Federal Trade Commission fines if they do not do so. The FTC also won’t allow comments or other features such as pop-ups meant to increase viewership. YouTube’s New Video Policy Places the Onus on Creators

Beginning in January 2020, YouTube will begin enforcement of a new policy that blocks data collection for content aimed at children. The result for content creators will be lower ad revenue; viewers will no longer see popular features such as comments and end screens. Google confirmed the new policy is the result of a $170 million settlement in September that YouTube reached with the Federal Trade Commission for allegedly violating children’s privacy rights under the Children’s Online Privacy Protection Act (COPPA). Google Will Pay $170 Million in Record COPPA Settlement

The FTC and New York attorney general announced yesterday that Google is being fined $170 million following the investigation of YouTube’s alleged violations of the Children’s Online Privacy Protection Act (COPPA). The investigation claims that Google marketed the video platform to advertisers based on the popularity of channels with younger audiences, and tracked viewing histories of children to serve them ads, without first getting consent of the parents. Google and YouTube will pay $136 million to the FTC and $34 million to New York in the largest COPPA fine to date (Congress enacted the law in 1998). Google Filters Appropriate Content with YouTube Kids Site

Kid-friendly video content is now available on a dedicated YouTube Kids website that filters content deemed most appropriate based on three different age groups. The site offers a similar experience to the mobile app of the same name. Parents can select age-appropriate videos based on newly listed age groups, track viewing history and flag anything that may be missed by filters. A sign-in option is expected to be added in the future. The filters include “Preschool” (up to age 4), “Younger” (ages 5 to 7) and “Older” (kids over 7). YouTube Finalizes Plans to End Targeted Ads For Children

YouTube has agreed to stop targeted ads that appear during videos that children are likely to watch, said sources. The Federal Trade Commission, which has been investigating whether YouTube violated the Children’s Online Privacy Protection Act (COPPA), reached an agreement with the company but hasn’t made its terms public yet. It isn’t clear whether YouTube’s move to end targeted ads in children’s videos is in response to the settlement. Amazon Will Launch New Echo Dot Kids Edition This Month

Amazon debuted a new version of its Echo Dot Kids Edition and several notable changes to its FreeTime Unlimited subscription service for children’s content. The new Echo Dot for children offers a new fabric case, including two colors — blue and rainbow stripes — both not available for the adult version. It is 70 percent louder than the first version, as is the new Echo Dot. The new Kids Edition will begin shipping June 26 for $69.99, $10 less than the first Kids Edition and will include access to FreeTime Unlimited for one year.
