Montana has become the first state to institute an outright ban on TikTok, barring it from operating in the region and prohibiting app stores from providing downloads there. The move is opposed not only by the Chinese-owned TikTok, but by free speech advocacy groups including the American Civil Liberties Union. The ban is set to go into effect January 1, 2024, though legal challenges could delay that implementation. Observers say the inevitable lawsuits fighting the legislation could prove instructive as relates to proposed federal TikTok bans in development in Washington. Montana law may soon include a total ban on TikTok, as governor Greg Gianforte decides whether to sign a first-of-its-kind prohibition approved by the state’s House of Representatives on Friday. The legislation would also seek to prevent app stores doing business in the state from carrying TikTok. Gianforte will also have the option to veto the proposal, or take no action for 10 days after the bill hits his desk, in which case it becomes law without his signature. Such a ban would likely be challenging to enforce at the state level. Blocking users from TikTok has gained bipartisan support at the federal level, though efforts to pass nationwide legislation have failed. Apple and Best Buy announced the two companies are extending their partnership so that technicians can repair iPhones at any of the 992 Best Buy locations in the U.S. The companies also revealed that 7,600 Geek Squad techs are now certified for iPhone repairs using genuine parts from Apple. While Apple will continue to offer repairs at its own stores, the new deal should prove beneficial to iPhone users in Montana, North Dakota, South Dakota, Vermont, West Virginia and Wyoming, since Apple does not presently have stores in these states. TV startup Aereo has temporarily shut down its service in Denver and Salt Lake City. The U.S. Court of Appeals for the Tenth Circuit refused to overturn a preliminary injunction granted by a Utah District Court judge that prohibits Aereo from operating in Colorado, Montana, New Mexico, Oklahoma, Utah and Wyoming. Aereo is issuing full refunds for this month to customers in the two cities. Despite the setback, Aereo continues its expansion with a recent launch in Austin, Texas one week before the SXSW conference. Some senators argued that implementing an Internet sales tax would be harmful to taxpayers, would be anti-business and would create a “bureaucratic nightmare.” Nonetheless, endorsement of Internet sales taxes onto a Democratic budget bill passed easily in the Senate last week by a 75 to 24 margin.
