A government study finds that while IP theft is commonplace in the world of NFTs, existing laws can be applied to protect U.S. copyright, trademark and patent rights. Those are the findings of a study released this month by the U.S. Patent and Trademark Office in conjunction with the U.S. Copyright Office. Senators Thom Tillis (R-North Carolina) and Patrick Leahy (D-Vermont) introduced the SMART Copyright Act of 2022, bipartisan legislation they say will “hold tech accountable by developing effective, widely-available measures to combat copyright theft.” While intellectual property owners see the proposal as a positive step to protect creators, critics view it as a potential threat to free speech. Essentially an update to 1998’s Digital Millennium Copyright Act, SMART allows the U.S. Copyright Office to create standard technical measures (STMs) to protect rightsholders through a filtering system implemented by online hosting platforms. In its deal with Oracle, ByteDance is angling for majority ownership of TikTok. “Conceptually, I can tell you I don’t like that,” responded President Donald Trump, who is still in favor of U.S. majority ownership of the app’s operations. Although Trump admitted he hadn’t been briefed on the specifics of the deal, Senate Republicans and others are concerned that it falls short of the original goal. A source stated that Treasury Secretary Steven Mnuchin aims to ensure that U.S. ownership is “well over 50 percent.” Meanwhile, the Commerce Department, at President Trump’s direction, announced this morning that TikTok and WeChat will be banned from app stores in the U.S. beginning on Sunday. In recent years, some cities have created broadband networks to provide Internet in communities — especially rural ones — where commercial services aren’t willing to set up shop. Those so-called “municipal broadband networks” just got slapped down by the U.S. Court of Appeals for the Sixth Circuit, which upheld laws in North Carolina and Tennessee halting their growth. For now, the ruling only impacts networks in those two states, but other cities that have created municipal networks have taken note.
