Microsoft has begun laying the groundwork to gain regulatory approval for its $68 billion Activision Blizzard bid, assuring D.C. decision-makers the purchase will not improperly advantage its own platforms and services. In an effort at transparency, Microsoft CEO Satya Nadella and president Brad Smith say they’re “sharing where we’re going with members of Congress” and meeting with think tank representatives to compile a best-practices road map to ensure lawmakers and stakeholders the deal presents no threat. FTC Develops New Antitrust Strategies for Taking on Big Tech

The Federal Trade Commission is taking an alternative approach to antitrust protections and Big Tech, focusing not on the ultimate harms of monopolies to consumers but rather the damage perpetrated by the giants inflicted on smaller companies that are often their partners. For an agency that since the mid-80s has focused its antitrust actions on the price-gouging or shoddy goods that usually result from consolidation, the new strategy may be an effective way to rein-in companies that offer their services free of charge, like Google and Facebook, or at what appears to be market rate, like Amazon. Euro Parliament Toughens Stance on Surveillance Advertising

The European Parliament has added amendments to the EU’s proposed Digital Services Act that will further strengthen consumer protections and make it more difficult for Big Tech to continue tactics for surveillance advertising and microtargeting. The new amendments, advanced at a plenary session last week, are significant in part because they apply to digital services more broadly than the original DSA, which targets “gatekeeper” companies like Google and Facebook. Parliament had already endorsed a full ban on the profiling of minors as well as limiting the use of special category data for ad serving. When it comes to vacuuming-up consumer data, there is no distinction between that which is “personally identifiable” and that which is not, according to recent media reports. Data collection firms are reportedly hiding behind a false notion of privacy in order to keep Congress on track to allow the industry to police itself. This would enable the companies to continue mining personal information and selling it, whether to those trying to influence election outcomes, pharmaceutical firms trying to boost sales or insurance companies sniffing around for preexisting conditions. TikTok Adjusts Feed to Curb Repetition, Offers Users Control

TikTok is tweaking its For You feed so users won’t be recommended too much of the same content. The move follows a global spate of regulatory hearings that took social media companies to task for promoting content that intentionally polarizes adults and potentially harms children. In addition to “diversifying recommendations” in order to “interrupt repetitive patterns” around topics that may provide negative reinforcement, like “loneliness or weight loss,” the popular ByteDance platform said it is also introducing a new feature that will allow users to avoid specific topics or creators. Didi Exits NYSE for Hong Kong, China Tightens Tech Control

China is making an investment statement as it attempts to take control of its financial future and set new yen-centric standards for international monetary exchange. Much is being read into Didi Chuxing delisting itself Friday from the New York Stock Exchange, where it raised billions of dollars, capping at $39 billion for the Beijing version of Uber. The message is: with money of its own and a knack for finding more, the world’s No. 2 economy feels it no longer needs Wall Street and says it will relist on the Stock Exchange of Hong Kong. Automated News Feed May Be Good for Facebook and Users

Facebook’s internal experiments with turning off its News Feed algorithm revealed that users benefit from the often-controversial ranking system. Documents recently parsed by the news media indicate Facebook’s digital formula knows more about what users want than the users themselves when it comes to deciding which posts people see and in what order. The news comes as both the House of Representatives and Senate consider bills that would require social media platforms to offer users the option of disabling what’s known as “automated content recommendations.” The bills follow whistleblower allegations that Facebook’s News Feed is damaging to users. FB Whistleblower Testimony Accelerates EU Regulatory Push

Facebook whistleblower Frances Haugen’s meetings with European Union officials have accelerated the lawmakers’ plans to tamp down Big Tech. Officials are calling for quick action to strengthen and enact measures of a 2020 bill that would impose strict obligations on social media companies. As currently drafted the bill would require technology platforms to monitor and mitigate risks from illegal content or suffer stiff fines. Likening Europe to “a digital Wild West,” EU digital commissioner Thierry Breton said, “Speed is everything” and EU members must pass the new tech legislation in the first half of 2022. Meta Halts Face Recognition Opt-In, Continues Development

Facebook parent Meta has announced it is shutting down the social network’s facial recognition technology program, deleting more than a billion individual face templates. Even users who have opted in will no longer be automatically recognized in photos and videos, according to the company. Snapchat Offers Tools for Parents, AR Studio for Advertisers

In the wake of a Congressional inquiry regarding the safety of minors using online platforms, Snapchat is preparing to debut “family engagement” tools, according to Snap CEO Evan Spiegel. Speaking at WSJ Tech Live, Spiegel said the features will allow parents greater control as to how children use the service. Spiegel emphasized privacy as built-in to Snapchat, noting “we never market our service to people under the age of 13.” Keen to market to millennials and Gen Zers, Snap also announced this week it’s launching Arcadia, a global creative studio focused on developing augmented reality advertising and experiences for brands. Facebook Said to Inflate AI Takedown Rates for Hate Speech

Although Facebook leadership has suggested that artificial intelligence will solve the company’s challenge to keep hate speech and violent content at bay, AI may not be a thoroughly effective near-term solution. That evaluation comes as part of a new examination of internal Facebook documents that allegedly indicate the social media company removes only a small percentage — quantified as low-single-digits — of posts deemed to violate its hate-speech rules. Algorithmic uncertainty as to whether content violates the rules results only in that it is fed to users less frequently, rather than flagged for further scrutiny. Lawmakers See Solution in Regulating Facebook’s Algorithm

U.S. lawmakers agitated by the recent testimony of Facebook whistleblower Frances Haugen and related media reports are homing in on the social network’s News Feed algorithm as ripe for regulation, although First Amendment questions loom. The past year has seen Congress introduce or reintroduce no fewer than five bills that expressly focus on software coding that decides who sees what content on social media platforms. Facebook vice president of global affairs Nick Clegg in a round of Sunday morning news appearances advocated his company’s position in the midst of senatorial attack, discussing new safety tools and emphasizing the company’s repeated requests for congressional guidelines. Means to deflect users from harmful content, curb political content and put programming power in the hands of parents were among the new measures by which to impede vulnerabilities. EU Report Tracks Decline in Voluntary Hate-Speech Removal

A voluntary hate-speech removal agreement among tech platforms in the European Union is trending in the opposite direction, according to the sixth evaluation report of the EU’s Code of Conduct, which produced a mixed picture. Social networks reviewing 81 percent of notifications within 24 hours removed an average of 62.5 percent of content flagged as hate speech, which is lower than the averages recorded in 2019 and 2020, according to the European Commission. Facebook Whistleblower Fuels Interest in Tougher Tech Laws

Facebook whistleblower Frances Haugen’s Senate testimony Tuesday appears to have fueled congressional desire to pass new regulations on Big Tech. At a hearing titled “Protecting Kids Online,” the inquiry expanded well beyond teens’ mental health, ranging from obsequious algorithms to Chinese surveillance of Uyghur populations, COVID-19 vaccine disinformation and speech leading to January’s Capitol insurrection. Calling Facebook “morally bankrupt,” Senator Richard Blumenthal (D-Connecticut) said “Big Tech is facing its Big Tobacco moment,” and urged Facebook CEO Mark Zuckerberg to testify.
