Jonathan Mayer has been named the Justice Department’s first chief science and technology advisor and will also hold the title chief artificial intelligence officer, another first. The announcement was made by Attorney General Merrick Garland, who said “the Justice Department must keep pace with rapidly evolving scientific and technological developments in order to fulfill our mission to uphold the rule of law, keep our country safe, and protect civil rights.” Mayer will advise Garland and department leaders and collaborate with other departments “on complex issues requiring technical expertise,” including cybersecurity, AI and other areas of emerging technology. The Supreme Court of the United States has delayed its decision in a request to hear three cases that would test the constitutionality of Texas and Florida laws that propose to allow lawsuits on the basis of political censorship by online platforms. Although the cases would not be heard until the court’s next session, which extends into 2024, the laws remain blocked in the interim. Rather than deciding outright whether it will grant certiorari, SCOTUS on Monday asked the Justice Department to file the Biden administration’s position, forestalling immediate deliberations. Facebook released the names of the members of its new Oversight Board, which has the power to overrule company chief executive Mark Zuckerberg. Law professor Kate Klonick dubs it a “historic moment,” and “the first time a private transnational company had voluntarily assigned a part of its policies to an external body like this.” Facebook’s four co-chairs spent much of 2020 choosing the other 16 members. The Federal Trade Commission is focused on acquisitions made by Big Tech companies, ordering Alphabet, Amazon, Apple and Microsoft to turn over information on such past deals. Specifically, the FTC wants to know about the smaller deals — many less than $100 million — that the companies were not required to report to regulators, in hopes of learning more about potential antitrust abuses.
