U.S. District Judge Yvonne Gonzalez Rogers ruled that Epic Games can maintain access to Apple’s Developer Tools but that its game “Fortnite” will stay out of its App Store. “Apple has chosen to act severely, and by doing so, has impacted non-parties, and a third-party developer ecosystem,” wrote the judge. Epic Games founder and chief executive Tim Sweeney is battling Apple and Google over their app store commissions. Marc Andreessen and other Silicon Valley venture capitalists are behind Clubhouse, an audio-based social media app that allows them to meet virtually. Still in beta, the invite-only app counts celebrity MC Hammer and activist DeRay Mckesson among its first members. According to sources, Andreessen Horowitz also beat out other venture firms to invest in Clubhouse, agreeing to infuse $10 million and pay $2 million to buy shares from the app’s existing shareholders. At WWDC 2017 this week, Apple debuted its first original series produced for distribution via Apple Music, aimed at its 27 million subscribers. The 10-episode “Planet of the Apps” features Jessica Alba, Gwyneth Paltrow, musician will.i.am and entrepreneur Gary Vaynerchuk. Structured similarly to “The Voice” and “Top Chef,” the show’s judges counsel inventors as they develop apps focusing on shopping, exercise and other services. Apple already produced a spinoff of “Carpool Karaoke” (to launch August 8) and acquired rights to a documentary about music tycoon Clive Davis. As part of its push to ramp up software offerings for enterprise customers, Cisco Systems is purchasing software maker AppDynamics Inc. for a premium $3.7 billion, just as the company was about to go public. AppDynamics software helps companies — including airlines, banks and retailers — monitor their applications’ performance and address any potential problems across cloud services offered by Google, IBM and others. CNN just made a deal to acquire Beme, a social media app founded by Casey Neistat, who has a huge millennial fan base, and Matt Hackett, former Tumblr vice president of engineering. As part of the deal, Beme’s 12 employees will join CNN. The idea behind Beme was to share “more authentic” video on social platforms, via four-second bursts that don’t allow the creator to edit the content.
