President Trump Signs the Music Modernization Act into Law

At a White House, President Trump signed the Music Modernization Act in a ceremony that was scaled back due to Trump’s monitoring of Hurricane Michael in Florida. The bipartisan act lets songwriters and artists be compensated for pre-1972 recordings, and gives them increased pay for works played on streaming services. In attendance were Kid Rock, the Doobie Brothers guitarist Jeff Baxter, MercyMe, The Beach Boys’ Mike Love, Craig Morgan, John Rich, and Sam Moore. Streaming Accounts for Nearly Two-Thirds of Music Revenue

According to a 2017 report from the Recording Industry Association of America, revenue for recorded music in the U.S. grew 16.5 percent last year to a retail value of $8.7 billion. “We‘re delighted by the progress so far,” explained RIAA CEO Cary Sherman, “but to put the numbers in context, these two years of growth only return the business to 60 percent of its peak size  —  about where it stood ten years ago  —  and that’s ignoring inflation.” Variety reports: “Like 2016, the boost came primarily from the rapid growth in paid music subscriptions to services like Spotify, Amazon, Apple Music, Tidal, Pandora and others, which grew by more than 50 percent.” Streaming represented nearly two-thirds of music revenue last year. Documentarians, Trade Associations Debate Copyright Laws

One of the gray areas of the Digital Millennium Copyright Act (DMCA) is the exemption for filmmakers. Although documentary filmmakers are allowed to use small pieces of copyrighted films in some circumstances, many of them say the provision is unclear and can lead to confusion and uncertainty. In late 2017, the International Documentary Association, Kartemquin Films, Independent Filmmaker Project, University of Film and Video Association and others asked the U.S. Copyright Office for clarity. Trade associations including the MPAA, RIAA and ESA have expressed concerns regarding exemptions. Musicians and Music Groups Push for Updated Copyright Law

Musical artists and music organizations are banding together in an effort to pass copyright legislation on content recorded before February 17, 1972. A coalition of 213 artists and eight music organizations has joined forces to ask Congress to pass the “CLASSICS Act” (H.R. 3301/S. 2393), which would cover such older recordings, resulting in increased royalties for this older era of musical content. YouTube Signs Agreement With Universal, Sony Music Labels

After two years of negotiations, YouTube is finally inking a long-term pact with Universal Music Group and Sony Music Entertainment, the top two music labels. The new agreement, say the labels, establishes royalty rates for rights holders of professional music videos and user-loaded clips, offers stronger policing of uploads of copyrighted songs, and gives artists more money and flexibility. Paid Subs for Streaming Music Services Top 30 Million in U.S.

The music business is experiencing significant growth, thanks in large part to the increasing popularity of streaming services. According to RIAA’s midyear report, leading services such as Spotify and Apple Music currently have 30.4 million paid subscribers in the U.S. (up from 20.2 million the previous year). Streaming services are now responsible for 62 percent of total industry revenue, followed by 19 percent for digital downloads, 16 percent for physical sales, and 3 percent for synch rights. U.S. Federal Court Closes Largest Music Stream-Ripping Site

Approximately 60 million global visitors to German-operated YouTube-mp3.org have availed themselves of pirated music every month, worth millions of dollars every year. The free ride is over, as the U.S. Federal Court Central District of California just ruled in favor of the Recording Industry Association of America (RIAA), which brought a suit on behalf of music labels. The now-shuttered site and others like it operate by removing the audio file from a music video and distributing it as a free permanent download. Internet Firms Now Describe Themselves as Content Leaders

Google and other members of tech trade groups have gone up against the entertainment industry’s chief lobbying organizations in recent years, but now the tech firms are describing themselves in a new light. “We are the new faces of the American content industry, winning Emmys and Oscars, providing distribution for streaming-only Grammy winners, while creating services that address the challenge of piracy by allowing consumers to legally access content globally,” states a letter sent to U.S. Trade Representative Robert Lighthizer, which details concerns regarding the North American Free Trade Agreement. Music Industry, YouTube Battle Over Perceived ‘Value Gap’

As the $7.7 billion U.S. music industry has moved from CDs to streaming, the top venue has become — not Spotify or Pandora — but YouTube, which is responsible for 25 percent of all music streamed. But that’s a problem since accessing music on YouTube is free, and music labels are increasingly unhappy that the platform pays less for songs than other streaming sites, calling it a threat to the music industry. Ad Trade Group Launches New Tool to Blacklist Piracy Apps

Trustworthy Accountability Group (TAG), an advertising industry alliance, has introduced a tool that will track apps promoting piracy, to alert advertisers not to run ads on such apps. The blacklist, which currently lists 8,000 violators, will be continuously updated with mobile apps that enable dissemination of pirated content, including music, movies, TV shows and games. TAG members and other organizations will help with the continual update. The MPAA and the Recording Industry Association of America both support TAG’s effort. Chinese Search Engine Baidu Now Defender of Copyright Law

Since Baidu began creating and licensing content, the Chinese search engine titan has become focused on protecting copyright, a complete U-turn from the days when it was often accused of being a pipeline for pirated content. Among its newly licensed content are original shows from Netflix. Data from China’s Supreme People’s Court reveals that almost 87,000 copyright-related cases were filed in the country in 2016, a figure that is 15-times more than the cases filed ten years previously. Copyright Holders Demand DMCA Update, Addition of Filtering

According to the Recording Industry Association of America and 14 other groups, the 19-year-old Digital Millennium Copyright Act (DMCA) needs to be updated. They’re telling the U.S. Copyright Office that new piracy controls are required. Currently, ISPs that “expeditiously” remove copyrighted content when alerted by rights holders get legal immunity or so-called safe harbor. But the RIAA and others say this process is not sufficient, as the pirated copy reappears instantly, requiring yet another takedown notice. Media Industry Opts to Pull the Plug on Copyright Alert System

Internet service providers, Hollywood studios and record labels have opted not to extend their pact to combat peer-to-peer piracy via the voluntary program that involved issuing “copyright alerts” to offenders. The voluntary program was launched in 2013 as a means of fighting piracy without calling for congressional legislation. Internet users who accessed pirated P2P content were issued warnings, and “six-strike” repeat offenders faced penalties such as the slowing of their Internet delivery. Music Industry Contends with Major Uptick in Counterfeit CDs

Despite shifts in music consumption involving streaming services, Internet radio, digital downloads and more, many consumers are still purchasing CDs. However, the revenue does not always reach the artists and labels responsible for the music, since piracy is running rampant in the form of counterfeit CDs offered through online retailers such as Amazon. Counterfeits are becoming increasingly difficult to distinguish from the official versions. While CD sales represented a mere 13 percent of revenue for U.S. labels the first half of this year, they accounted for almost 40 percent of global revenue for the recording industry last year. Top Record Labels File Lawsuit Against YouTube Ripping Site

Sony, Universal, Warner Bros. and other record labels are taking legal action against the German operator of website YouTube-mp3.org, claiming that the industry is being robbed of revenue from streaming, downloads and advertising. BBC notes that the site provides an easy-to-use method of downloading audio from YouTube videos. The labels filed the suit in a federal court in Los Angeles, seeking damages including $150,000 per each alleged act of piracy. According to the labels, “tens, or even hundreds, of millions of tracks are illegally copied and distributed by stream-ripping services each month.” YouTube-mp3.org is described as the “chief offender,” with more than 60 million monthly users.
