EU Hits Apple with Antitrust Objections Over Mobile Payments

European regulators on Monday hit Apple with an antitrust charge, alleging it has created a “closed system” for contactless mobile payments. The so-called statement of objections says the iPhone maker has abused its market power by favoring its Apple Pay for mobile contactless payments to the detriment of third-party services like PayPal, which reportedly helped initiate the charges. Snap Adds Users, Boosts Revenue, Posts $360 Million Loss

Snap has grown daily users to 332 million, an 18 percent increase in Q1 according to an earnings report. The January through March period reflects a 38 percent year-over-year revenue increase, but also documents a net loss of $360 million. The deficit — attributed to digital advertising circumstances including Apple’s new privacy policies, the war in Ukraine and the effects of inflation — comes on the heels of Snap’s first-ever quarterly profit in Q4 2021. Meta Pushes Forward with Its Plans for High-End AR Glasses

Meta Platforms’ future plans are coming into focus through leaks and the company’s admission that it plans to take a fee of up to 47.5 percent on digital asset sales transacted through the Meta Quest Store in the “Horizon Worlds” game. By 2024, the company reportedly plans to deliver its first generation high-end wireless AR glasses, developed as Project Nazare, along with a cheaper pair codenamed Hypernova. Meta aims to bundle both models with a wrist-worn controller that “hypothetically” issues instructions direct from the wearer’s mind, leveraging technology the company acquired with the 2019 purchase of CTRL-labs. Antitrust legislation pending in the U.S. and European Union is at odds with consumer privacy initiatives in those territories, Apple CEO Tim Cook told attendees of the IAPP Global Privacy Summit 2022 in Washington, D.C. on Tuesday. FTC Chair Khan Calls for Privacy Rules and Data Limitations

Federal Trade Commission chair Lina Khan says it’s time for the FTC and Congress to deliver on consumer privacy protection, legislating to ensure that consumers don’t have to surrender personal data in order to enjoy online tools that are essential to everyday life. Speaking Monday at the IAPP Global Privacy Summit 2022 in Washington, D.C., Khan emphasized creating “substantive limits rather than just procedural protections” when it comes to personal data. Latest Privacy Moves Do Not Prevent Consumer Ad Tracking

In April, Apple gave consumers the option to turn off ad tracking on iPhones, and this month Google began revealing plans to replace traditional cookie tracking with what it says will be a less intrusive measure. Experts say, however, these changes don’t actually safeguard data privacy. Rather, companies are taking a new approach that consolidates data power among fewer gatekeepers, a change some say may be for the worse. The new method, known as “first-party” tracking, prevents accruing a tracking history from app to app, but lets specific sites gather info with consumer permission. Researchers Discover Malware on Apps in Google Play Store

Google has removed dozens of apps from the Google Play Store after finding they were harvesting data from millions of Android phones. The spyware creator, Panama’s  Measurement Systems S. de R.L., has been linked with a Virginia defense contractor that has done work for U.S. national-security agencies in the areas of cyberintelligence, network defense and intelligence intercepts. Researchers found the errant code embedded in apps for Muslim prayers, speed-trap detection, QR-code reading and other popular consumer programs that have been downloaded more than 10 million times. Google Testing New Data Protections with Privacy Sandbox

Google is advancing to the next stage of trials for its Privacy Sandbox — a  proposal centered on advertising relevance and measurement. The new Sandbox ad targeting tech stack is under consideration as a replacement for the tracking-based cookie approach that has been the norm in Chrome. Described as a revenue-friendly user privacy enhancement, the new stack is being discussed as potentially going into effect in the second half of 2023. Starting last week, developers could begin global testing of the Topics, FLEDGE, and Attribution Reporting APIs in the Canary version of Chrome. National Advertisers Embrace Streaming Audio and Podcasts

The audience for streaming audio continues to grow, and advertisers are taking notice. A 2021 survey found that 68 percent of U.S. listeners listened to digital audio in the previous month, compared to 47 percent in 2014. While streaming audio advertising still lags behind traditional radio, changes in consumer privacy policies at Apple and the effect that’s had on social media platforms has prompted brands and small businesses to explore their options. Roughly $5.7 billion will be spent on U.S. digital audio ads in 2022, up 14 percent over 2021, according to Interpublic Group’s Magna media unit. Designed for productivity, the $799 Nimo mixed reality eyewear is powered by a Qualcomm Snapdragon XR1 processor that has been described as turning the spectacles into “a mini-computer that sits on your head.” Relatively light at 120 grams, the lenses can display up to six 720p screens, suggesting it as a potential laptop replacement for traveling workers. Europe and U.S. Data-Sharing Pact to Replace Privacy Shield

The Supreme Court’s recent FBI v. Fazaga decision regarding surveillance has been interpreted by some as an obstacle to Biden administration efforts to secure an effective replacement for the EU-U.S. Privacy Shield. Originally implemented in 2016, thousands of U.S. companies had been relying on the Privacy Shield to centralize customer data. In 2020, the Court of Justice of the European Union (CJEU) nullified the framework after finding U.S. surveillance laws provide a loophole for unauthorized access to data belonging to EU citizens. EU Digital Markets Act Poised to Compel Apple ‘Sideloading’

The EU is preparing to finalize its Digital Markets Act (DMA) designed to neutralize Big Tech’s gatekeeper status by leveling the playing field with smaller competitors. The DMA, which could be completed by month’s end, has ramifications for Amazon, Google and parent Alphabet, and especially for Apple, which faces what some describe as an existential threat through provisions that would allow software to be downloaded outside the App Store and third-party payment systems inserted on apps, known as “sideloading.” Failure to comply could carry fines and penalties totaling tens of billions of dollars. Meta Adding Parent Controls for Instagram and Virtual Reality

Meta Platforms is beginning to implement parental controls on Instagram and Quest. Last week, Instagram added a Family Center that will eventually expand to allow parents and guardians to “help teens manage experiences across Meta technologies from one central place.” Meta says parental controls will be added to Quest VR in May, and hinted others, like Facebook, are queued-up to join. The Family Center will allow parents to monitor how much time their teens spend on Instagram, setting limits if they choose. Big Tech executives may find themselves facing UK prosecution or jail time sooner than expected as the target date for Online Safety Bill (OSB) enforcement collapses to within two months of becoming law, rather than the two years originally proposed. Several new offenses have been added to the bill, including criminal liability for those who destroy evidence, fail to cooperate with Ofcom investigations or impede regulatory inspections. Innovative California Privacy Law Sets Stage for Entire Nation

As the first state to implement privacy laws protecting consumers from Big Tech, California is being closely watched as it puts together a governing body with the job of regulating how Amazon, Google, Meta and other companies collect and exploit data from millions of people.
