Washington policymakers have identified stablecoins as the initial target for stricter cryptocurrency regulation. Stablecoins — which are backed by a reserve asset — are booming due to investors using them to trade among other cryptocurrencies. The stablecoin sector grew by about 500 percent in the 12-month period ending October 31, according to a report issued by the Biden administration. While there are four basic types of stablecoin, the ones collateralized by fiat currency — and specifically the U.S. dollar — is by far the most popular. SMART Copyright Act Updates DMCA in Fight Against Piracy

Senators Thom Tillis (R-North Carolina) and Patrick Leahy (D-Vermont) introduced the SMART Copyright Act of 2022, bipartisan legislation they say will “hold tech accountable by developing effective, widely-available measures to combat copyright theft.” While intellectual property owners see the proposal as a positive step to protect creators, critics view it as a potential threat to free speech. Essentially an update to 1998’s Digital Millennium Copyright Act, SMART allows the U.S. Copyright Office to create standard technical measures (STMs) to protect rightsholders through a filtering system implemented by online hosting platforms. EU Digital Markets Act Poised to Compel Apple ‘Sideloading’

The EU is preparing to finalize its Digital Markets Act (DMA) designed to neutralize Big Tech’s gatekeeper status by leveling the playing field with smaller competitors. The DMA, which could be completed by month’s end, has ramifications for Amazon, Google and parent Alphabet, and especially for Apple, which faces what some describe as an existential threat through provisions that would allow software to be downloaded outside the App Store and third-party payment systems inserted on apps, known as “sideloading.” Failure to comply could carry fines and penalties totaling tens of billions of dollars. Meta Adding Parent Controls for Instagram and Virtual Reality

Meta Platforms is beginning to implement parental controls on Instagram and Quest. Last week, Instagram added a Family Center that will eventually expand to allow parents and guardians to “help teens manage experiences across Meta technologies from one central place.” Meta says parental controls will be added to Quest VR in May, and hinted others, like Facebook, are queued-up to join. The Family Center will allow parents to monitor how much time their teens spend on Instagram, setting limits if they choose. Big Tech executives may find themselves facing UK prosecution or jail time sooner than expected as the target date for Online Safety Bill (OSB) enforcement collapses to within two months of becoming law, rather than the two years originally proposed. Several new offenses have been added to the bill, including criminal liability for those who destroy evidence, fail to cooperate with Ofcom investigations or impede regulatory inspections. UK-style child protections are coming to the U.S. if a pair of California state lawmakers have anything to say about it. Assembly members Jordan Cunningham, a Republican, and Buffy Wicks, a Democrat, last week proposed the California Age-Appropriate Design Code Act, a bill modeled after what is popularly known in the UK as the Children’s Code, and more formally tagged the Age Appropriate Design Code. If enacted, websites and social platforms would have to limit the collection of children’s data in California, enact safeguards protecting minors from other users, minimize addictive features and simplify privacy settings. Data Act Aims to Protect EU Consumers in Smart Device Era

The European Commission has proposed new rules on who can use and access data generated across economic sectors in the European Union. The proposed legislation would require Amazon, Microsoft, Google and other cloud service providers as well as those who harvest data to establish safeguards preventing non-EU governments from illegally accessing EU consumer information. “We want to give consumers and companies even more control over what can be done with their data, clarifying who can access data and on what terms,” said Margrethe Vestager, the EC’s commissioner for competition, in announcing the Data Act. Kids Online Safety Act Advocates Holding Tech Accountable

A bipartisan bill to protect kids online was introduced Wednesday by Senators Richard Blumenthal (D-Connecticut) and Marsha Blackburn (R-Tennessee). The Kids Online Safety Act (KOSA) would give parents more control over social media settings, add opt-out features and establish a “duty of care” that opens the door to liability and lawsuits. “Big Tech has brazenly failed children and betrayed its trust, putting profits above safety,” said Blumenthal. “This measure makes kids’ safety an Internet priority.” The bill follows a media blitz and months of Congressional hearings on the danger of social media to the mental and physical health of young users. Google Advertising Puts Alphabet Profit Up 36 Percent in Q4

Google parent Alphabet posted Q4 2021 revenue of $75.33 billion, a 32 percent increase over the same period in 2020 that outperformed expectations. The blowout results were attributed to small and large businesses embracing digital advertising as a way to reach consumers housebound by COVID-19. Profits rose 36 percent to $20.64 billion in Q4. Alphabet revenue for the year ending December 31 was $257.6 billion, a 41 percent increase over 2020. The company also announced a 20-for-1 stock split. Alphabet CEO Sundar Pichai cited “a quarterly sales record for our Pixel phones despite supply constraints” among the achievements. Euro Parliament Toughens Stance on Surveillance Advertising

The European Parliament has added amendments to the EU’s proposed Digital Services Act that will further strengthen consumer protections and make it more difficult for Big Tech to continue tactics for surveillance advertising and microtargeting. The new amendments, advanced at a plenary session last week, are significant in part because they apply to digital services more broadly than the original DSA, which targets “gatekeeper” companies like Google and Facebook. Judge Rules That FTC Can Proceed with Meta Antitrust Case

A federal judge has allowed a Federal Trade Commission antitrust lawsuit against Facebook to proceed, denying dismissal, a major victory for the agency as it gears up to take on Big Tech. The FTC claims the company, which since renamed itself Meta Platforms, accrued monopoly power and abused it by harming competition through an acquisitions strategy described as “buy or bury.” The U.S. District Court for the District of Columbia ruling is seen as a warning to tech behemoths like Amazon, Apple and Google and the armies of lobbyists and lawyers employed to protect their interests. European Commission Advances New Rules for Big Gig Firms

The European Commission took steps last week to require ride-hailing firms and others to classify drivers and couriers as employees, which would entitle them to minimum wage and other legal protections. Should they go into effect, the proposed rules would impact some 4.1 million people, and would make the European Union among the strictest in the world when it comes to protecting so-called gig workers. Uber and others that depend on low labor costs and limited liability are expected to fight the proposal, which must proceed through several legislative steps before being codified as law. Senate Tells Instagram CEO the ‘Time for Self-Policing is Over’

Instagram CEO Adam Mosseri spent more than two hours in the Senate hot seat last week, answering questions about the platform’s safety policies and impact on teens’ mental health. A bipartisan phalanx grilled the executive on topics ranging from algorithms to eating disorders. Mosseri, who was appearing in Congress for the first time, defended his social platform, a division of Meta Platforms, which also owns Facebook. Government Questions Liability Shield Offered by Section 230

The U.S. House of Representatives is signaling intent to proceed with legislation to scale back the Section 230 liability shield for Big Tech. The move follows a frontal assault on Australia’s version of the law by the Parliament and global saber-rattling against protections that prevent social platforms being held legally accountable for user-posted content that harms others. At a Wednesday hearing on various Section 230 bills, House Energy and Commerce Committee chairman Frank Pallone (D-New Jersey) said that while the protections were vital to Internet growth, they have resulted in anti-social behavior.
