Music Fairness Act to Secure Radio Payments for Performers

The House Judiciary Committee has approved the American Music Fairness Act, which would require broadcast radio stations to pay royalties to performance artists and musicians. Currently only songwriters and publishers get royalties for terrestrial radio play. The U.S. is unusual among developed nations in failing to provide a legal framework for performer compensation for songs played on-air — a vestigial artifact from the days when radio was a fledgling media and airplay was considered promotion for record sales. ‘Fortnite’ Metaverse Build-Out Gets iHeartLand Music Venue

Epic Games is getting another major venue in its “Fortnite” metaverse with an iHeartMedia digital headquarters. The complex, iHeartLand, includes a main stage, recording studio and game park. An interesting example of how virtual reality is mapping IRL commercially, the concert venue struck a naming rights deal with insurance company State Farm. In addition to avatar concerts, State Farm Park features a large screen that can display 2D performances, the format chosen by inaugural guest Charlie Puth for his September 9 show. Apple Pursues Podcasts as Subjects for Streaming TV Series

Apple is making a big push for original podcasts that have the potential to be turned into shows for Apple TV+. The company has signed a deal with Futuro, producer of the criminal-justice podcast “Suave,” and has already spent about $10 million on the push, led by Apple TV Studios. Apple recently announced original podcasts with companies including Pineapple Street Studios, Campside Media, Jigsaw Productions and At Will Media. Apple TV+ has already adapted existing podcasts including Wondery’s “The Shrink Next Door” (starring Paul Rudd and Will Ferrell) and “WeCrashed” (with Jared Leto and Anne Hathaway). Apple vs. Spotify: Battle for Podcasting Dominance Heats Up

The rivalry between Apple and Spotify to dominate the growing podcast market has heated up. Apple launched paid podcast subscriptions and Spotify recently partnered with Facebook to spur discovery. In its latest move, Spotify also launched a podcast subscription model but, unlike Apple, which keeps 30 percent of the fees, Spotify will allow content creators to keep 100 percent. Podcasting, which skyrocketed in popularity during the COVID-19 pandemic, is expected to bring in $1+ billion in advertising revenue this year. SiriusXM Ups Its Podcast Profile with the Purchase of Stitcher

SiriusXM is buying podcast platform Stitcher from the E.W. Scripps Company for $325 million. Scripps purchased Stitcher from Deezer in 2016 for $4.5 million, combining it with Midroll Media, which it bought for $55 million the previous year. Stitcher enables advertisers, creators and publishers to both produce and distribute content. With Stitcher, SiriusXM can now offer original podcasts for listeners. Scripps said Stitcher’s 2019 revenue was $72.5 million, for a compound annual growth rate of 52 percent from 2016 through 2019. Marvel to Create Exclusive Podcasts for SiriusXM, Pandora

The Walt Disney Company’s Marvel Entertainment inked a deal with SiriusXM to create exclusive podcasts for the latter’s satellite radio and streaming services, including Pandora. This is SiriusXM’s first major effort in podcasting and is also an attempt to attract more listeners. The deal comes at a time that many media companies are taking their first steps into podcasting. Disney has also focused on expanding Marvel out of big movie theaters and into broadcast television and its Disney+ streaming service. Media Companies Look to Expand Podcasting Outside U.S.

Acquired by iHeartMedia, the podcast “Stuff You Should Know” is now on track for global expansion. The podcast, which has been downloaded more than a billion times in the last 11 years, tackles topics as diverse as artificial sweeteners, time zones and deepfakes. As part of the expansion, iHeartMedia will make “Stuff You Should Know” and five other podcasts available next year in French, German, Hindi, Portuguese and Spanish. Last year, the radio broadcaster bought StuffMedia, the studio that produces the podcast, for $55 million. A number of other media companies are also taking a global approach to podcasting. Apple Takes On Original Podcasting to Compete with Rivals

To compete with Spotify and Stitcher, Apple plans to roll out exclusive original podcasts and is already in conversation with media companies to do so, said sources. The company has not yet described its strategy, but did say it will make unprecedented deals to build up its podcast collection. Industry experts reported that, currently, 50 to 70 percent of all podcast listening already takes place from the Apple Podcasts app. Since debuting Apple Podcasts in 2005, however, Apple has made few changes. Sirius to Acquire Pandora Media in $3.5 Billion All-Stock Deal

Satellite radio giant SiriusXM is acquiring online music service Pandora Media in a $3.5 billion all-stock deal. The deal should help John Malone’s SiriusXM reach beyond its current audience that most commonly listens while driving, and better compete with Spotify. The satellite radio operator paid $480 million last year for a 19 percent stake in Pandora when it started losing subscribers to streaming services. Billionaire Malone has been expanding his radio empire; in addition to the Pandora deal, his Liberty Media has expressed interest in iHeartMedia. Radio Company iHeartMedia Files for Bankruptcy Protection

The largest owner of radio stations in the U.S., iHeartMedia Inc., filed for Chapter 11 bankruptcy last week to address $20 billion in debt. “The company said the agreement it ‍reached with holders of more than $10 billion of its outstanding debt would restructure its balance sheet by transferring 94 percent of the stock in the reorganized company to its lenders,” reports Reuters. The company has struggled with significant debt since its $17.9 billion leveraged buyout of Clear Channel Communications in 2008. Spotify Turns to Podcasts to Expand Content, Boost Ad Sales

Spotify has inked an agreement to promote podcasts in its app and on bus ads, in exchange for the hosts of those podcasts publicizing Spotify on social media and during their shows. “Reply All,” “Pod Save America” and “The Bill Simmons Podcast,” which cover a range of topics from sports to politics, are the three podcasts that have signed on. With this agreement, Spotify is experimenting with putting resources into programming other than music. Apple currently is the leader in podcast subscriptions. Milestone: iHeartRadio Exceeds 60 Million Registered Users

Last week, iHeartRadio announced that it had reached over 60 million registered users. The streaming service is distinct from its competitors such as Pandora and Spotify in that it also allows users to access stations for free without the need to register. Only those who opt for listening to playlists and accessing more personalized features need to register with the service. This unique model makes it difficult to compare to Spotify’s 60 million active monthly users or Pandora’s registered 250 million users. Music Industry: Rulings Could Have Long-Term Consequences

In a 57-page decision issued this week, a New York federal judge ruled against music streaming service Grooveshark in a copyright infringement case. The judge ruled that the service’s parent company, Escape Media Group, and co-founders Samuel Tarantino and Josh Greenberg, had uploaded almost 6,000 songs without licenses, and urged their employees to do the same. Meanwhile, a California judge ruled in favor of musicians Flo & Eddie in a suit against SiriusXM, and now the duo is taking on Pandora. Clear Channel Emphasizes Digital with iHeartMedia Rebranding

Maker of the popular iHeartRadio app, Clear Channel Communications, will rename itself iHeartMedia as it moves further towards digital media following the success of its radio streaming efforts. The iHeartRadio Network, which includes the websites of Clear Channel’s broadcast stations like KIIS in Los Angeles, attracts 97 million visitors per month.
