The line between “fair use” in copyright law and outright theft has often been unclear, but a recent U.S. District Court ruling drew the line on a case involving Equals Three Studios and viral-video aggregator Jukin Media. Jukin accused Equals Three of illegally taking dozens of clips for use in its own YouTube show. Equals Three sued Jukin, saying its actions were protected by fair use, and that Jukin’s takedown deprived it of ad revenue. Nielsen, long the dominant player in audience measurement data for media companies and advertisers, now has competition. Recently, comScore, which measures consumer Web activity, made an all-stock purchase of Rentrak, which monitors set-top box data for information on consumers’ TV viewing habits. Nielsen, however, countered with its “total audience measurement tool,” which is slated to roll out by the end of 2015. Apple plans to include its Flipboard-like newsreader app, simply named News, in the upcoming iOS 9 this fall. First announced at WWDC in June with 18 publishers on board, News now touts more than 50 publishers. Conde Nast, Hearst and Vox Media are among the initial launch partners hoping that iPhone and iPad users will consume more of their content. While some publishers have expressed concerns about ad-blocking capabilities made possible by iOS 9, launch partners are pleased with Apple’s advertising terms. According to a new report from eMarketer, photo and video sharing app Instagram, which does not have a desktop ad product, is projected to bring in $595 million in mobile advertising revenue worldwide this year. The report predicts the Facebook-owned network will reach $1.48 billion in mobile ad revenue in 2016 and $2.81 billion the following year. By 2017, eMarketer expects Instagram will account for more than 10 percent of Facebook’s total ad revenue and, in the U.S., Instagram will have higher net mobile display ad revenues than Google and Twitter.

Videos on Facebook garner 4 billion views a day — 75 percent on smartphones — and the company is increasing its efforts to turn views into profits. Its newly unveiled strategy is to share ad revenue with video creators, both to attract better content and more ads. Facebook will keep 45 percent of the revenue, similar to YouTube’s revenue model, but the two differ in a significant way: Facebook will divide the creators’ 55 percent share of ad revenue among all the videos that appear adjacent to the ad, based on how long users watch each video. Social bookmarking site Pinterest is bolstering its advertising strategy with a “cinematic pins” feature that adds motion to users’ boards. These special pins play short animations at the same speed that a user is scrolling. When the user clicks on an ad, the pin plays a longer version of the video. These new ads are part of a revamped strategy designed to compete with Twitter and Facebook. Advertisers will now have more targeting options and access to a new ad-creating service. Twitch, the videogame-streaming site that Amazon acquired for nearly $1 billion last year, is now broadcasting online poker players. Twitch reportedly draws in about 100 million users each month, a number that is expected to increase with an additional wave of viewers tuning in for the poker channels. Subscription-based, video sharing website Vessel launched yesterday in beta. Developed by former Hulu CEO Jason Kilar, Vessel aims to change the business of online video by offering a $2.99-per-month service that features exclusive early access to professional Web video. Additionally, Vessel will offer creators (such as online personality Connor Franta or fashion video blogger Ingrid Nilsen) 70 percent of ad revenue and 60 percent of subscription revenue. YouTube has confirmed a new feature that will play suggested follow up videos at the end of a viewed video. The video autoplay is currently being tested among a small percentage of users. Autoplay could replace YouTube’s current suggested video grid that appears at the end of every video.
