FilmOn: Broadcasters Score Big Against TV Streaming Service

Television broadcasters including Fox, NBCU, Disney/ABC, Allbritton Communications and Telemundo filed a copyright infringement suit in May against Alki David’s TV digital streaming service FilmOn X (formerly called BarryDriller), which works similarly to the controversial Aereo service, backed by Barry Diller’s IAC. On Thursday, a federal judge in Washington ruled in favor of the broadcasters, issuing a near-nationwide preliminary injunction against FilmOn X. Networks Continue Legal Battles with Broadcast Disruptors

Two recent legal cases are creating problems for broadcasters. A federal appeals court refused to rehear a case in which broadcasters attempted to shut down Aereo, a company that allows users to record broadcast TV online, and another appeals court declined a case to prevent Dish Network from selling its Hopper service, which allows viewers to bypass TV commercials. New Audio App is the Pandora for Podcasts and News Radio

Silicon Valley startup Concept.io has launched the Swell smartphone app, which automatically collects Internet radio and podcast content based on user interest. Swell tracks what content is played, how often, and what is skipped, using an algorithm to build a user profile. The app also tracks a user’s Twitter stream to identify areas of interest in order to add relevant audio programs. Yahoo Continues Shopping Spree of Mobile App Companies

Following its recent acquisition of Tumblr, Yahoo is in advanced talks to purchase social video app Qwiki for $50 million, according to sources familiar with the matter. The New York startup’s iPhone app allows users to create short movies from photos, music and video clips. Yahoo paid more than $1.1 billion for Tumblr several weeks ago and is reportedly close to purchasing San Francisco-based address book app creator Xobni for $30-$40 million. Television Fans Edit Their Own Versions of Favorite Shows

Television viewers are uploading episodes of their favorite shows and re-editing them, marking the next step in the increasingly interactive relationship with media content. One viewer unpacked the nesting-doll narrative of “Arrested Development” when the new season was released on Netflix, and re-edited it in chronological order before posting links on Reddit. Fans of HBO’s “Game of Thrones” recently posted their versions of a particularly violent scene to YouTube, after setting it to pop music and cartoon sound effects. Netflix and Hulu Plus Most Popular with Mobile TV Viewers

The majority of television content viewed on mobile devices is accessed through Netflix and Hulu Plus, rather than via networks or pay TV providers, suggests a new study commissioned by the Council for Research Excellence (funded by Nielsen). About 64 percent of shows watched on smartphones and 54 percent on tablets were accessed through online video-subscription services, while broadcast and cable websites and apps only accounted for 26 percent of TV viewed on mobile devices. Broadcast Networks Hope to Stop Aereokiller DC Expansion

Fox, NBC, ABC and Allbritton Communications have filed a lawsuit in U.S. District Court in Washington against Aereokiller, to block the streaming startup from expanding its service to the nation’s capital. Founded by FilmOn’s Alki David, Aereokiller gets its name from Barry Diller-backed Aereo. Last week we reported that David agreed to change his company name in order to settle a trademark infringement lawsuit filed by Aereo. Pay TV Operators Time Warner Cable and DirecTV Eye Hulu

The number of potential bidders for Hulu grew late last week when it was reported that Time Warner Cable and DirecTV are both interested in the six-year-old online video site. Other firms that have expressed interest in Hulu include Guggenheim Partners, Yahoo and Peter Chernin’s investment group. The video site — jointly owned by Comcast, Disney and News Corp. — has reportedly been considering a range of strategic options, including a sale. Upfronts: USA Network Unveils Screen Unification Strategy

TBS and TNT to Offer Live Streaming and New Mobile Apps

In the wake of ABC’s announcement that it would upgrade its app to live-stream local programming in the New York and Philadelphia areas, TBS and TNT plan to offer live 24/7 streaming of their series and sports coverage beginning this summer. The streams will be available via the channels’ websites and soon-to-launch mobile apps called Watch TNT and Watch TBS. ABC App to Offer Live Streams of TV Shows for Subscribers

ABC will upgrade its app for iPhones and iPads this week with a “live” button that will allow viewers in the New York and Philadelphia areas to live-stream local ABC programming. The live stream, which will also be offered via ABC-owned stations in six other cities this summer, will be made available only to cable and satellite subscribers. Aereo Files Complaint Against CBS Prior to Boston Launch

Aereo filed a complaint against CBS yesterday as a preemptive strike to stop the network from filing additional lawsuits. The move marks the latest chapter of what has become a tug-and-war between broadcasters and Aereo, the Barry Diller-backed startup that provides access to over-the-air TV broadcasts via the Web.
